Welcome to Brainfast. By accessing or using https://brainfast.ai (the "Service"), you agree to these Terms of Service ("Terms").

Please read them carefully.

1. Acceptance of Terms

By using our platform, you agree to these Terms and our Privacy Policy. If you disagree, please do not use the Service.

2. Service Description

Brainfast provides AI chatbot creation, deployment, and automation tools that help businesses and individuals build conversational experiences.

3. User Accounts

You must:

• Be at least 16 years old.
• Provide accurate information during registration.
• Keep your credentials secure and confidential.

We reserve the right to suspend or terminate accounts violating these Terms.

4. Use Restrictions

You agree not to:

• Use Brainfast for unlawful, harmful, or deceptive purposes.
• Interfere with or disrupt platform functionality.
• Attempt to reverse engineer or exploit our system without authorization.

5. Intellectual Property

All platform content, including code, design, and documentation, is owned by Brainfast. You retain ownership of the chatbots and data you create.

6. Plans, Pricing & Billing

Brainfast is offered through a free tier and a paid Pro subscription, alongside a usage-based balance (your "Wallet") that pays for the AI your agents consume. By subscribing or adding funds, you agree to the pricing described below and shown in your account at the time of purchase.

6.1 Free plan

The Free plan lets you build and preview agents at no cost, with no payment method required. Live AI usage — agents answering real customers, placing or taking calls, and performing tasks that consume AI — requires an active Pro subscription and a funded Wallet.

6.2 Pro subscription

Pro unlocks the full platform on a recurring subscription:

• $19 / month, or $190 / year (the equivalent of two months free versus paying monthly).
• Includes 3 AI agents. You can add more agents for $5 / month each, with no upper limit; added agents are billed as part of your subscription.
• Any promotional or launch pricing (for example, an introductory discount off the standard rate) is temporary and applies only while it is offered. Unless we state otherwise, renewals are charged at the then-current standard price.

Subscriptions renew automatically for the same interval until you cancel. You may cancel at any time: cancellation stops future renewals, and you keep Pro access through the end of the period you have already paid for. Except where required by law, subscription fees already paid are non-refundable, including for partial periods.

6.3 AI usage and your Wallet

The AI that powers your agents — answers, voice and phone calls, and other actions — is paid from a prepaid balance you control, called your Wallet. The Wallet is separate from your subscription:

• You top up your Wallet in advance (from a $20 minimum), much like a prepaid phone.
• As your agents work, the cost of each action is deducted from your balance in real dollars. When nothing is running, nothing is charged.
• Your Wallet balance does not expire. It can be used only for AI usage on Brainfast and, except where required by law, top-ups are non-refundable and cannot be exchanged for cash.

6.4 How usage is priced (transparency)

AI usage is billed at the cost charged by the underlying third-party AI providers (such as OpenAI, Anthropic, and Google) plus a service margin. That margin covers the infrastructure, orchestration, monitoring, and support that make these models usable inside Brainfast, and it is already included in the per-use prices shown in your dashboard. In other words, the amount deducted from your Wallet is the actual, all-in dollar figure — there are no separate or hidden add-ons. Per-use prices vary by the AI model and feature used and may change as underlying provider costs change; your dashboard always reflects current pricing and itemizes every charge by agent and conversation.

6.5 Taxes, payment processing, and changes

Prices are exclusive of taxes unless stated otherwise, and you are responsible for any applicable taxes. Payments are handled by our third-party payment processor; you authorize us and that processor to charge your selected payment method for subscription fees and Wallet top-ups. We may change our plans, fees, and usage pricing from time to time. We will communicate material changes, and continued use of the Service after a change takes effect constitutes your acceptance of it.

7. Limitation of Liability

Brainfast is provided "as is" and "as available."

We are not liable for indirect, incidental, or consequential damages resulting from your use of the Service.

8. Termination

We may suspend or terminate access for violations or at our discretion. Upon termination, your right to use the Service ends immediately.

9. Governing Law

These Terms are governed by and interpreted according to the laws of Morocco, without regard to conflicts of law.
